Please note:
Once an order has been confirmed with the restaurant, preparation may begin immediately.
For this reason, we cannot accept cancellations after confirmation has been made.
Important!If you do not understand any of the languages in which this document is currently available, we strongly request you not to agree and not accept the agreement and, consequently, not to continue to use the application. In case of any differences between a translation and the English version, the English version prevails. General Terms & Conditions of business for online ordering
You may find "somewhere something" similar to TOMIK "chicken strips" or "fish and chips" or another "dishes", but only TOMIK have original recipes since 2011 !

We are not just a coffee bar - we are a full-service restaurant that values quality food, genuine hospitality, and mutual respect. We cater to all your needs - breakfast, brunch, lunch & dinner, coffee, freshly squeezed juices, milkshakes, and smoothies. Many vegetarian, vegan, gluten- and dairy-free options are available.
All your favourites are here, including the FAMOUS Chicken Strips, Fish & Chips, great salads, quesadillas, create-your-own breakfasts, and many more dishes.

Intellectual Property Notice - Menu
The menu of TOMIK Restaurant & Snack-Bar, including all dish names, descriptions, design, layout, and recipes, is protected under the Portuguese Copyright Code (Código do Direito de Autor e dos Direitos Conexos, Lei n.º 45/85) and the Industrial Property Code (Código da Propriedade Industrial, Art. 311.º and following), as well as applicable EU legislation (Directive 2001/29/EC).
It is strictly forbidden to photograph, copy, reproduce, or otherwise record our menu without prior written authorization from the owner. This prohibition applies to any act of sharing the menu, in whole or in part, with third parties, including competitors. If a photograph is taken for personal use, it must remain private and must not be shared on any third-party platforms or with competitors.
Any unauthorized use, reproduction, or imitation - including the creation of menus with similar names or descriptions - constitutes copyright infringement and unfair competition. Such acts will result in immediate legal action, with claims for damages, seizure of infringing materials, and possible criminal complaints under Portuguese law.
We have already identified competitors using copied menus and will continue to monitor and enforce our rights without prior notice.
Order and Reservation Policy
Dear guests of TOMIK Restaurant,
Thank you for your interest in our food and cakes — we are happy to be part of your special moments.
To ensure smooth preparation and avoid no-shows, we kindly ask you to follow these simple rules for pre-orders and reservations:
Phone Orders:
We accept small phone orders without prepayment, limited to the value of two burgers. This option is available only to clients we already know well. All other orders should be placed via our website with online payment.
Cakes & Special Orders:
Orders for cakes and other special dishes must be prepaid via our website and ordered 3 days in advance.
Table Reservations:
Daytime reservations (until 16:00) can be made by phone without a deposit.
For Friday evenings (after 18:00) and weekends, reservations are accepted:
Only via the website with a €25.00 deposit,
Or in person at the restaurant with payment of the same deposit ( €25.00 ).

Conditions which allow a TOMIK Restaurant to Refuse Service
Listed below there several legal reasons for a restaurant to refuse service, some of which include:
- Discrimination and racism:
Will not be tolerated at TOMIK. We have a zero-tolerance policy toward any racist remarks, hate speech, or drug-related incidents. Any member or guest involved will be asked to leave immediately, and membership (if applicable) will be permanently revoked without reimbursement. Any guests involved will be permanently banned from the TOMIK Restaurant and its premises.
- Unbooked events or meetings:
Events or group meetings without a booked and prepaid table made at least 3 days in advance through our website are not allowed.
- Rude or disrespectful behavior:
Any walk-in or guest customer who acts in a rude or disruptive manner toward other guests or restaurant staff will be asked to leave.
- Alcohol or drugs:
Walk-in guests under the influence of alcohol or drugs will not be served.
- Outside food or drinks:
Bringing your own food or beverages into the restaurant is not permitted. This includes takeaway coffee, bottled drinks, or snacks purchased elsewhere. All food and beverages consumed on the premises must be ordered from TOMIK Restaurant, in accordance with health and safety regulations.
- Overcapacity:
Walk-in guests exceeding the restaurant’s maximum capacity may be refused entry due to safety regulations.
- After closing time:
Guests entering the restaurant after it has closed, or after the last order period (30 minutes before closing), will not be served.
- Rowdy groups:
Guests accompanied by large groups of non-customers intending to create noise or disruptive behavior after hours will be denied service.
- Hygiene and cleanliness:
Guests lacking adequate hygiene may be refused service, as this can compromise the health and safety of others in the restaurant.
- Pets:
Guests bringing dogs or other animals into the restaurant may be refused service unless the pet is a certified service animal protected under the EU Disabilities Act. Pets must always be clean and free of dirt.
- Dress code:
TOMIK reserves the right to deny entry to guests not meeting the minimum dress code standards required for etiquette purposes.
- Unclear intent:
Guests entering the establishment without a clear intention to dine (e.g., saying “maybe some food” or “maybe a drink”) may be refused service — especially during busy hours. Additionally, walk-in guests who initially agree to dine (“yes, for food”) but then change their mind after being seated (“no, I just want coffee”) create confusion and disrupt restaurant organization. Such situations may also result in refusal of service, particularly during peak times or when table availability is limited.
- Noise and children:
To maintain a pleasant and relaxing atmosphere for all, we kindly ask parents to ensure their children remain seated, calm, and supervised at all times. Excessive noise, shouting, or behavior that disturbs other guests’ privacy or dining experience may result in being asked to leave.
- Mistreatment of staff:
Taking out frustration or bad behavior on your waiter or staff is never acceptable. Waitstaff work hard to make your experience enjoyable, and they deserve respect at all times. Even if service falls short of expectations, guests are expected to communicate politely and respectfully. Constructive feedback is always welcome, but rudeness, insults, or posting malicious reviews are not tolerated.
As a private business, TOMIK Restaurant reserves the right to deny or refuse service to any customer for any reason. If a customer abuses any of our policies, we will unfortunately be unable to continue business with them — this ensures that we can keep offering excellent food and service to our valued guests.
We kindly ask that anyone whose intention is to spread negativity chooses another place.

Booking Terms & Conditions
To secure your booking, a €25.00 deposit is required per table, or a €75.00 deposit for groups of 8 people for Sunday bookings (Private Dining or Events). This amount will be deducted from your final bill and is fully refundable if the booking is canceled at least 48 hours in advance. Deposits must be paid by debit card only (credit cards are not accepted). Bookings without a deposit will not be held and may be cancelled without notice. Please note: In case of damage to restaurant property, the cost of repair or replacement will be charged to the customer.
Bookings are great for busy times, to avoid misunderstanding, please Book Your Table or Pre-order your dishes one day in advance. Thank You! WHY I SHOULD RESERVE A TABLE IN TOMIK? We want to offer an excellent customer experience so they will remember fondly.
0. TOMIK Members
- TOMIK Members book the table through User Dashboard by login on TOMIK website or directly visiting TOMIK
1. Reservation Duration
- All reservations are allocated a dining time of 1.5 hours (90 minutes).
2. Reservation Holding Period
- Tables will be held for a maximum of 15 minutes from the reservation start time. If guests have not arrived within this period, the table may be released to other customers and the booking automatically cancelled.
Important: Bookings are only confirmed once the deposit is received. Reservations without a deposit may be cancelled at any time.
3. Confirmation of Bookings
- Bookings for groups larger than 4 people are confirmed only upon receipt of a deposit by the Restaurant.
- Changes to booking details must be made at least 48 hours before the booking date. Changes will only take effect once acknowledged by the Restaurant.
4. Group Set Menu Requirement
- Bookings of 12 or more people are required to dine from the group set menu.
5. Deposit Requirements
- A deposit is required immediately to secure the booking, and payments must be cleared funds at the time of booking.
- Bookings of 4 or more people must pay a deposit, which can be made via Stripe ( payment by Debit card ) in Cash or Bank Transfer payment ( ask in TOMIK )
- The total bill must be settled in full on the day of the booking, with the deposit deducted from the final bill. Deposits for no-shows are non-refundable.
- In case of damage to restaurant property, the cost of repair or replacement will be charged to the customer.
6. Minimum Spend and Payment
- The minimum spend for bookings is agreed upon at the time of booking and includes VAT but excludes a 23.0% optional service charge (applicable to large parties, events or meetings).
- No credit facilities are available, and all customers booking for Fridays and Sundays must order at least one main meal.
- Queries or complaints about the bill must be submitted in writing within two business days of the booking date.
- In cases of unforeseen events (e.g., pandemics or force majeure), the Restaurant is not liable for upfront payments but may offer an option to reschedule.
7. Non-Payment of Deposit
- Failure to pay the required deposit in cleared funds may result in the cancellation of the booking without liability to the Restaurant. Any associated costs may also be charged to you.
8. Cancellations
By You: For cancellations:
- Groups of up to six: Notify the Restaurant at least 2 days in advance.
- Larger groups and private bookings: Notify the Restaurant at least 4 days in advance.
- Late cancellations are non-refundable.
A cancellation fee of €25.00 will be charged if the booking does not show or is cancelled with less than 48 hours notice. We require confirmation of final numbers 48 hours prior to the booking. This is the minimum amount that will be charged.
By the Restaurant:
- The restaurant may cancel bookings without liability due to circumstances beyond its control (e.g., fire, equipment failure, staff disputes, or orders issued by public authorities). In such cases, your booking deposit will be fully refunded.
9. Final Numbers for Reservations
- Final headcount must be confirmed in writing at least two days before the booking date.
- Charges apply for the full number of guests booked if changes are not made at least two business days prior.
- The Restaurant will endeavour to accommodate increases in guest numbers but cannot guarantee availability or service.
10. Menu Selection
- Groups larger than six must choose a uniform menu for all guests, with accommodations made for dietary requirements.
- Dietary requirements should be communicated when the menu is selected, and final menu and wine choices must be submitted five days prior to the booking.
- The Restaurant reserves the right to suggest alternatives if menu items or wines become unavailable.
11. Allergies and Intolerances
Notify the Restaurant of any allergies or intolerances prior to ordering. Guests with severe allergies should be aware that, despite precautions, cross-contamination may occur. Any bespoke orders are consumed at the guest’s own risk. Guests should always advise the restaurant of any special dietary requirements, including intolerances and allergies. Where possible, our trained staff will advise you on alternative dishes like dishes marked as GF (Gluten Free) is a Gluten Free, dishes marked as Dairy Free is a Dairy Free.
The information provided on our website and in our restaurants should NOT be considered as any form of guarantee but as a best faith effort to provide you with information on our dishes. You should use this information to help you assess your own level of risk, based on your personal circumstances, before eating any of our dishes
12. Guest Conduct
- Guests are expected to behave lawfully and avoid causing nuisance or endangering licenses held by the Restaurant.
- Illegal activities, including drug use, betting, or gaming, are prohibited.
- The Restaurant reserves the right to refuse entry or eject guests due to inappropriate behaviour.
13. Dress Code
Smart casual attire is required.
14. Limitation of Liability
- The Restaurant’s liability for personal injury or death due to its negligence is not limited.
- Guests are responsible for any damages caused to the Restaurant’s property by their actions or negligence.
House Rules
- Please treat our restaurant, furniture, and tableware with care.
- Any damage to property (e.g., broken glass, spilled drinks, damaged furniture) may be added to the final bill.
- Respectful behavior is required at all times. Loud shouting, whistling, or disturbing conversations are not allowed, either inside or on the terrace.
- Respect towards our staff and other guests is above all. Any rude or offensive behavior will not be tolerated.

Important Notes
- Loyalty Discount Codes expire after 28 days.

Gluten Free
Menu items marked as GF meet the FDA specified definition of less than 20 parts per million for a gluten free claim. Please note that our restaurant are not set up as a strictly gluten free environment.
Online Ordering
We accept Online Orders, our online payment gateaway is STRIPE.. Minimum order is 5 items online. An item is defined as 5 x minimum quantity (minimum €43.00) that can be ordered of a specific items. (Please note that in some instances products are only available in cases and this one case is the equivalent of 1 item only. Inside the Establishment we accept cash only).
"Single" prices are for orders of less than 10 items in your trolley.
"Mix (10+)" prices are applied for orders of 10 or more items. In this instance, the prices will change automatically for your entire order.
For some items where they are more than 1 bottle in a single item, we may offer the discounted price regardless of the number of items in your trolley and these will be identifiable as prices will appear the same for both on these items. To get this discount, you have to be registered through the link, wich You have received from one of Your friends, who is already registered at TOMIK TMK website, this link Your friend/affiliate can find in "User Panel" in "Refer & Earn" section of the "User Panel"...
Once accepted, no order may be cancelled without the prior written agreement of a owner of the TOMIK TMK Restaurant.
Orders may be accepted by the Company by despatching the Goods, but despatch will not be acceptance where the price has been incorrectly quoted or referenced by the Customer in its order.

TOMIK Restaurant reserves the right to decline to trade with any company or person. Without prejudice to the generality of the foregoing, the Company adopts the following policy at all its delivery/collection points: CHALLENGE 21: You must be 21 or over to buy alcohol. You must not buy alcohol on behalf of under 21's. We apply "Challenge 21" policy to all Take Away and collection orders. We will not supply if the person receiving or collecting orders appears under the age of 21.
Please note: We strive to prepare and package our pick-up items to preserve the high quality of the food. Keep in mind the temperature, sauce, and consistency of some items may vary slightly after being packaged.
Food Ordering (Dine-In / TakeAway) Inside the Establishment
For the Minimum order is 5 items for the Dine-In or TakeAway an item is defined as 5 x minimum quantity (over €43) that can be ordered of a specific items.
Please note: for extra a side of ground chili, chili sauce etc., price starts from €0.80 & up. Inside the Establishment we accept cash only.
Food Ordering (TakeAway)
Please note: for the TakeAway you may pay extra:

Spice Level
We offer a choice of spice levels (Mild, Medium, Hot) but spice can be different for everyone. We usually suggest that you are on the side of caution and choose a lower spice level because you can add spice in, but can’t take it out! We do not offer discounts or refunds for a preferred different spice level, but please let us know if you’d like us to add a side of ground chili, chili sauce or Sriracha for you.
Refunds are not typically provided for food that a guest simply does not like.
Payment
Payment is due in cleared funds prior to dispatch of Goods. Payments for online ordering / pre-orders we accept all major credit cards from customers in every country. Inside the establishment we accept by CASH only (for TakeAway pickup or Dine-In). Payment inside of the Establishment we accept payment by CASH only. If we do the Delivery (Special order over €135) - we require that delivery address must be registered to a Portuguese address. This is to ensure that all payments are made on a secure network and customers are protected against fraudulent activity. Our Online payment gateaway is STRIPE.
Payment Options
For the online Food Ordering you can use "Cash (Dinheiro)" payment option, "Digital Wallet" payment option or "Credit Card" payment option.
What are digital wallet?
Digital Wallet reduce fraud and increase conversion on mobile. Our Customers can use wallets to pay online with a digital wallet balance. A digital wallet is an application that operates on mobile devices such as smartphones and tablets and stores payment information, allowing users to pay for purchases directly from their devices instead of using their physical debit or credit cards. Digital wallets eliminate the need for customers to enter their card and billing information manually, making it a fast and simple payment option online. Digital wallets also allow users to view payment histories and often store other important documents digitally.
Payment Options (Lower than €43.00)
For Food Ordering in the Establishment with ammount Lower than €43.00 inside the Establishment we accept by "Cash (Dinheiro)" payment option only, or you can add money (charge) your "Digital Wallet" on our official website "few days" in advance and pay inside the Establishment by your Digital Wallet ballance.
Also we can "popup" your Digital Wallet from TOMIK, to do this you need to Register at our website by this link, visit us at the Establishment and bring some cash, which you would like to keep in your online Digital Wallet.
Prices
Prices are in € EURO, inclusive of IVA (VAT). The Company has used all reasonable endeavours to ensure that prices are accurately set out in the Web Site but reserves the right to change its prices without notice at any time. Prices charged will be those prevailing when your order is accepted. Where your order is supplied in instalments (“Scheduled Delivery” if special order) the price payable will be that applicable at the time of dispatch of the first part of your order but, where Scheduled Delivery may continue for a period of 90 days or more, the Company reserves the right to charge the Customer further amounts if the price of the Goods increases before the end of that period.
Ordering & Confirmation
If you would like to buy any Goods on this Website, please click on ‘Add to Cart +’. This will be an offer from you to buy the Goods. We reserve the right to reject any offer received from you. If we accept your offer, we will notify you. A legally binding contract will be formed between us at the time of sending the notification to you. You agree to be bound by the terms and conditions set out below. We may vary our terms and conditions at any time.
Complimentary (Free) Food
Sorry, we do not provide the "Complimentary (Free) Food" .
Limitation of Liability
Neither TOMIK TMK nor its directors or employees will be liable for any damages or injury caused by, including but not limited to, any failure of performance, error, omission, interruption, defect, delay in operation of transmission, computer virus, or line failure, nor will such individuals or entities be liable for any damages or injury, including but not limited to, special or consequential damages that result from the use of, or the inability to use, the materials in this Site, even if there is negligence on TOMIK TMK, its agents or contractors, or an authorized TOMIK TMK representative has been advised of the possibility of such damages, or both. In no event shall TOMIK TMK total liability to you for all losses, damages, and causes of action (in contract, tort [including without limitation, negligence], or otherwise) be greater than the amount you paid to access the Site.

Catering
DEPOSIT: To confirm your booking, we require a 75 % deposit and a detailed confirmation sheet, signed for acceptance.
NUMBERS: Numbers of people to cater for must be confirmed 1 (one) week prior to the function and those numbers will be catered for and charged for.
BALANCE: Balance due Prior to delivery.
LOSS: All losses / breakages to property of the Business of Catering or any of its subcontractors will be billed to you at the replacement value plus 23% VAT.
PART CATERING: We do not do “part” catering as this interferes with the integrity of our product. Except in situations where we are confident that our product will not be confused with that of another service provider.
PRICES: We reserve the right to amend prices should our cost price fluctuate beyond our reasonable control.
FLEXIBILITY: Whilst we – at all times – strive to be flexible, all items changed after we have purchased their ingredients, will be charged for at full quoted price.
SUBSTITUTIONS: Should an ingredient, for any reason, be unavailable we reserve the right to replace it with a suitable substitute.

CANCELLATIONS: The organizers of the function will be liable for the following in the event of the function being cancelled:
- Within 7 (seven) days of the function date: the full quoted price;
- 14 (fourteen) to 8 (eight) days prior to the function: 50% of the quoted price;
- 21 (twenty one) to 15 (fifteen) days prior the function: 25% of the quoted price.
LEGAL ACTION: In the event of the Business of Catering instituting legal action against you for any reason, you agree that any ruling in our favour shall include all costs, commissions and interest incurred as a result of the dispute which gave rise to legal action being taken.

Pets in restaurants: What you need to know ...
Pets can accompany owners to some commercial establishments, such as restaurants. However, according to the legislation that allows animals to enter restaurants, it is necessary that the people responsible for the spaces authorize and post the information in a visible place.
- 1.1. What changes with the law of animals in restaurants?
- From May on, it will be possible to take pets to commercial establishments, such as restaurants. As long as they respect the rules and are treated. To date, pets are not allowed in commercial spaces.

- 1.7 Even if they accept animals, can restaurants refuse the entry of any animals?
- Yes. An animal with a lack of hygiene and dangerous behavior may not be accepted in the commercial establishment, even if its entry is allowed through the space.
We allow your Pets only on terrace area (outside), all pets must be on leash, must be hygienically and clean, pets with no hygiene signs like dirt, sand, dust or sick, will be not accepted.
